Where the rules differ

Rules differ by state; check yours. That applies to consent for minors, health records and privacy notices, cosmetic procedures, mental health, employment, telehealth recording, direct debit, and waivers.

Consent for minors

This set has no general consent form for minors. In South Australia a person aged 16 or over can consent as an adult. In New South Wales a minor aged 14 or over can give a consent that answers an assault claim. Elsewhere, capacity follows the common-law test. Rules differ by state; check yours.

Health records and privacy

GEN-002 is the privacy notice. Health-records laws in Victoria, New South Wales and the ACT apply to private providers as well as the Australian Privacy Principles. Fitness and beauty records can be health information. Do not tell a clinic that answers stay in Australia unless they actually do. Rules differ by state; check yours.

Mental health questionnaires

This set does not include a mental health questionnaire. Link to the instruments. Do not copy the questions onto a form. Rules differ by state; check yours.

Employment and tax file numbers

This set has no employment form and no tax file number field. An employment form should link to the ATO TFN declaration, not rebuild it. A clinic must not ask a patient for a tax file number. Working-with-children checks, workers' compensation and payroll tax differ by state. Rules differ by state; check yours.

Telehealth recording and direct debit

This set has no recording consent and no direct-debit authority. Consent to record differs by state, including under the Surveillance Devices Act 1998 (WA). Unsolicited agreements can have a state cooling-off rule. Rules differ by state; check yours.

State/Territory waivers

Waiver and consent rules differ between states and territories. Check the civil liability law where you operate, and get your own legal advice if you're unsure.

About these templates

These templates are examples only, to help you get started. They are general information, not legal, medical, clinical or professional advice, and they may not suit your business, your profession or your state or territory.

Before you use any template, you must review and adapt it, and have it checked where needed, so it fits your services, your professional body's rules, privacy and health records laws, and the law where you operate. This matters most for consent, waiver, privacy and minors' forms. You are responsible for the forms you use and the information you collect.
